Terms of Stay
Article 1 (Scope of Application)
1. Accommodation contracts and related agreements concluded between our inn (hereinafter referred to as "the Inn") and a guest shall be governed by these terms and conditions. Matters not stipulated in these terms and conditions shall be governed by laws and regulations or generally established customs.
2. Notwithstanding the preceding paragraph, if the Inn agrees to a special contract to the extent that it does not violate laws, regulations, and customs, that special contract shall prevail.
Article 2 (Application for Accommodation Contract)
1. A person who intends to apply for an accommodation contract with the Inn shall provide the following information to the Inn:
- Name of the guest(s)
- Date of stay and estimated time of arrival
- Accommodation charges
- Other matters deemed necessary by the Inn
2. If a guest requests to extend their stay beyond the date specified in item 2 of the preceding paragraph during their stay, the Inn shall treat it as a new application for an accommodation contract at the time the request is made.
Article 3 (Conclusion of Accommodation Contract, etc.)
1. The accommodation contract shall be concluded when the Inn has accepted the application as stipulated in the preceding article. However, this shall not apply when the Inn has proven that it did not accept the application.
2. When the accommodation contract has been concluded in accordance with the preceding paragraph, the guest shall pay an application fee determined by the Inn, up to the amount of the basic accommodation charge for the period of stay, by the date specified by the Inn.
3. The application fee shall be applied first to the final accommodation charges to be paid by the guest. In the event that circumstances arise in which the provisions of Article 6 and Article 11 apply, the fee shall be applied to the penalty fee, followed by compensation for damages, in that order. Any remaining amount shall be returned at the time of payment of charges under the provisions of Article 9.
4. If the application fee stipulated in paragraph 2 is not paid by the date specified by the Inn in accordance with the provisions of the same paragraph, the accommodation contract shall become invalid. However, this shall apply only when the Inn has notified the guest of this fact when specifying the due date for payment of the application fee.
Article 4 (Refusal to Conclude an Accommodation Contract)
The Inn may refuse to conclude an accommodation contract in the following cases:
- When the application for accommodation is not in accordance with these terms and conditions.
- When there is no room available due to full occupancy.
- When it is recognized that the person intending to stay is likely to commit an act contrary to the provisions of laws and regulations, public order, or good morals in connection with the accommodation.
Article 5 (Guest's Right to Cancel the Contract)
1. The guest may cancel the accommodation contract by notifying the Inn.
2. If the guest cancels all or part of the accommodation contract for reasons attributable to the guest, the Inn will charge a penalty fee as set forth in the attached Appendix. However, in cases where the Inn has agreed to a special contract as stipulated in Article 3, paragraph 2, this shall apply only when the Inn has notified the guest of their obligation to pay the penalty fee when canceling the contract.
Article 6 (Inn's Right to Cancel the Contract)
1. The Inn may cancel the accommodation contract in the following cases:
- When it is recognized that the guest is likely to commit, or has committed, an act contrary to the provisions of laws and regulations, public order, or good morals in connection with the accommodation.
- When the guest does not comply with the prohibited items of the usage rules established by the Inn, such as smoking in bed, tampering with fire-fighting equipment, etc.
Article 7 (Registration of Stay)
1. The guest shall register the following information at the front desk of the Inn on the day of arrival:
- Name, age, gender, address, and occupation of the guest
- For guests from overseas: nationality, passport number, port of entry, and date of entry
- Departure date and scheduled departure time
- Other matters deemed necessary by the Inn
Article 8 (Room Usage Hours)
1. The hours during which the guest may use the guest rooms of the Inn shall be from 3:00 PM to 10:00 AM of the following morning. However, in the case of a consecutive stay, the room may be used all day, except for the day of arrival and the day of departure.
Article 9 (Payment of Charges)
1. The breakdown of accommodation charges, etc. to be paid by the guest is as shown in the attached Appendix.
2. Payment of accommodation charges, etc. as stipulated in the preceding paragraph shall be made in cash or by other methods accepted by the Inn, such as credit cards, at the front desk upon the guest's departure or when requested by the Inn.
3. Even if the guest voluntarily chooses not to stay after the Inn has provided the guest room and it has become available for use, the accommodation charge will still be charged.
Article 10 (Inn's Liability)
1. The Inn shall compensate the guest for any damage caused to the guest in the performance or non-performance of the accommodation contract and related contracts. However, this shall not apply if the damage is not due to reasons attributable to the Inn.
Article 11 (Handling When Unable to Provide the Contracted Room)
1. If the Inn is unable to provide the contracted room to the guest, the Inn shall, with the guest's consent, arrange for other accommodation under conditions as similar as possible.
2. If, notwithstanding the preceding paragraph, the Inn is unable to arrange for other accommodation, the Inn shall pay the guest a compensation fee equivalent to the penalty fee, which shall be applied to the amount of damages. However, if there are no reasons attributable to the Inn for being unable to provide a room, no compensation fee shall be paid.
Article 12 (Custody of Guest's Baggage or Belongings)
1. If a guest's baggage or belongings are left behind at the Inn after check-out, and the owner is identified, the Inn shall contact the owner and ask for instructions. However, if there are no instructions from the owner or if the owner cannot be identified, the items will be kept for 7 days including the day of discovery, and then processed in accordance with the law.
Article 13 (Guest's Liability)
If the Inn suffers damage due to the guest's intentional or negligent act, the guest shall compensate the Inn for such damage.
Appendix: Penalty Fees (related to Article 5)
Cancellation fees are as follows.
